Case
On June 9, 2014, Aurinda milk calcium soft capsule received the health certificate issued by Tianjin Entry-Exit Inspection and Quarantine Bureau.
On May 13, 2016, Mr. Li purchased this product and reported to the Tianjin Airport Entry-Exit Inspection and Quarantine Bureau that the product was not compliant.
On August 2, 2016, Tianjin Airports Entry-Exit Inspection and Quarantine Bureau confirmed that the Aurinda milk calcium soft capsules involved in the labeling contained “vitamin D3”.
The illegal fact
Chapter IV Article 38 of Food Safety Law
No medicine may be added to the food that is produced and operated, but it can be added to substances that are traditionally both food and herbal medicine.
Analysis
Vitamin D3 belongs to the "Pharmacopoeia" and cannot be used as a common food ingredient, So the addition of vitamin D3 is in violation of the "China Food Safety Law."
Penalty result
The label is not compliant, the payment is refunded, and 10 times compensation is paid, and the sale of this product is terminated.
